he Smoke Detecting Devices Notice is a required posting for owners of Class A multiple dwellings under Section 28 RCNY § 12-01. Building owners must post this notice in a form approved by HPD (Housing Preservation and Development) in a common area—preferably near the mailboxes or the inspection certificate. The notice informs tenants that the owner is legally required to install approved and operational smoke detecting devices in each dwelling unit and to replace them at the end of their useful life. It also explains that tenants are responsible for maintaining the detectors during their occupancy and reimbursing the owner up to $25 for smoke-only devices or $50 for combination smoke and carbon monoxide devices within one year of installation. Under Section 28 RCNY § 12-12.1, owners may instead choose to post a combined notice covering Smoke and Carbon Monoxide Detecting Devices as well as Gas Leak Procedures.
